Georgia's 6-week abortion ban has been struck down in court as unconstitutional
What’s Happening?
On September 30, a Georgia state judge struck down the state’s six-week abortion ban, reinstating legal abortion up to 22 weeks of pregnancy. Today, Judge Robert McBurney of Fulton County ruled that the law’s drastic reduction of the time frame for legal abortion, from around 20 weeks to just six weeks, violated Georgia’s interpretation of personal liberty. The ban, which was signed by Republican Gov. Brian Kemp back in 2019, took effect in July 2022 after the Supreme Court reversed Roe v. Wade. McBurney had previously declared the law unconstitutional, as it was passed in 2019 when Roe v. Wade still guaranteed federal abortion rights. However, the Georgia Supreme Court allowed the ban to remain in effect while legal proceedings continued. This latest ruling reverses that decision, restoring access to abortion in Georgia up to 22 weeks.
Today’s ruling comes just weeks after the tragic deaths of Amber Thurman and Candi Miller in Georgia due to the state’s restrictive abortion policies, further highlighting the legal and social battles surrounding abortion access. The decision represents a significant shift in Georgia’s abortion laws, reaffirming reproductive rights in the state.
